To their surprise, the taxpayer mounted a robust defense, raising multiple arguments. They asserted that the original transaction had undergone significant changes, causing delays and extending the completion date. How could the authorities issue an additional assessment for an unfinished transaction, they questioned?<\/p><p>In the High Court, the taxpayer argued that the Revenue\u2019s actions were premature. The judge found merit in the taxpayer\u2019s claims, ruling that the case raised triable issues. \u201cThis matter requires a full trial,\u201d the court declared, dismissing the Revenue\u2019s request for summary judgment.<\/p><p>For the taxpayer, this was a moment of hope. The completion date was extended. How can an assessment be valid for something that isn\u2019t finalized? This case is premature and lacks a proper foundation.\u201d<\/p><p>The tension in the courtroom was palpable. Judges pressed both sides with probing questions about the timing, the law, and the nature of the taxpayer\u2019s appeal.<\/p><p>In a decisive ruling, the Court of Appeal overturned the High Court\u2019s decision. \u201cThe issues raised by the taxpayer are matters of merit, which should be addressed before the Special Commissioners of Income Tax.
